The National Home Builders Registration Council, acting in terms of Section 7(1) (a) (ix) of the Housing Consumer Protection Measures Act 95 of 1998, has drawn up a Code of Conduct to provide the minimum standards that NHBRC Home Builders are required to maintain.

National Home Builders Registration Council: Code of Conduct for Home Builders

The provisions of the Code are designed to give protection to housing consumers who contract home builders to build their homes.  Included in the Code are significant provisions such as:

The home builder may not demand a deposit of greater than 10% of the contract price as deposit.

Chapter Two of the Code outlines the Duties of the Home Builder.

Chapter Three of the Code also provides that the home builder has a Duty to Disclose to the housing consumer all the facts pertaining to the home and land (of which the home builder is aware or should reasonably be aware) which may affect the housing consumer.

In addition the home builder is required to give the housing consumer thirty calendar days to examine the building contract and other relevant documents.

All home builders are required to sign an undertaking that they have received the Code of Conduct as a condition of membership.

Note: The Code of Conduct, Gazette No. 29689 of 16 March, 2007 has been repealed and replaced with the above Government Gazette Notice.
